Regulations of the 14th Michał Spisak International Music Competition (pdf)
I ORGANISER
Zagłębie Palace of Culture, with its registered office in Dąbrowa Górnicza (41-300), Plac Wolności 1, NIP no. 629-001-58-16, entered into the register of cultural institutions kept by the Municipality of Dąbrowa Górnicza under no. 3/2008, hereinafter referred to as Organiser.

III FORM OF THE COMPETITION
- The Competition is carried out in the field of culture and art.
- The Competition is held every two years.
- Each edition of the Competition is dedicated to different instruments.
- In 2023, the Competition will be held on 13–22 October and dedicated to the following instruments:
- trumpet
- horn
- trombone
- The Competition may be cancelled for reasons beyond control of the Organiser. However, this cannot happen later than until 18 August 2023. In case when the Competition is cancelled, any competition fees paid shall be returned to the participants (after the deduction of any bank fees due).
- Regardless of the above provision, the Competition may be cancelled as a result of the so-called force majeure and/or events and/or other circumstances beyond the Organiser’s control, which could not be prevented. Force majeure and/or fortuitous event shall be understood as external phenomena of an exceptional nature, which could not be foreseen and whose effects could not be prevented, even if all reasonable care is taken, in particular such as: fire, flood, strike, acts of war, internal riots, terrorist attack, acts of public authority, national mourning, and restrictions of the Ministry of Health related to COVID-19 pandemic.
IV CANDIDATES
- The candidate’s participation in the Competition is subject to simultaneous fulfilment of all conditions laid down in these Regulations.
- In 2023, the Competition is addressed to the musicians of all nationalities born after 13 October 1993.
- Any natural person with restricted and/or full legal capacity may participate in the Competition. The individuals with restricted legal capacity may take part in the Competition with written consent of their statutory representative or legal guardian.
V REGISTRATION AND QUALIFICATION FOR THE COMPETITION
- If you register for the Competition, you give consent to participate in the Competition and accept these Regulations.
- The deadline for registration in the Competition is 15 July 2023. Any applications delivered after the above-mentioned deadline, non-compliant with all registration conditions, or incomplete, shall be rejected.
- The candidates will be informed about correct registration and qualification for the first stage of the Competition by e-mail until 21 July 2023.
- The Organiser will not return to candidates any documents sent for the Competition.
- Registration takes place via the electronic application form available on the official website of the Competition spisakfestiwal.palac.art.pl / spisakfestival.palac.art.pl. The following appendices are required to be attached to the application form:
- A short biographical note to be used in publications related to the Competition. Proper names, e.g. names, surnames, institution names, shall be written correctly and in full. The note length shall not exceed 1,800 characters (including spaces). The biographical note shall be attached in .doc or .docx format (in Polish and in translation to English). The Organiser reserves the right to make abridgements, and edit the biographical notes.
- Two photographs showing the candidate’s current appearance, including at least one portrait photo, to be used in publications related to the Competition. The photos shall be attached in .jpg or .tiff format, with the minimum resolution of 300 dpi.
- In case of minors under 18 years of age, consent for participation in the Competition signed by the parent or guardian.
VI FEES
- The application fee is EUR 100 or its equivalent, converted at the average exchange rate of the National Bank of Poland as at the date preceding the day of making the payment of the application fee. The application fee shall be paid to the following bank account of the Organiser:

- In case of a withdrawal from participation in the Competition, the fees paid shall not be refunded.
- As part of the fee, the Participant has the right to use the services of an accompanist provided by the Organizer – within one rehearsal and one performance in the 1st and the 2nd stage of the competition. The participant has the right to submit his own accompanist in the application form and the Organizer does not bear the costs of his salary, accommodation and stay.
- The costs of the bank transfer shall be incurred by the sender.
VII COURSE OF THE COMPETITION
- The Opening Concert will take place on 13 October 2023.
- The competition auditions will be open to the public and will take place in three stages:
- First stage (14–15 October 2023) – auditions of all participants admitted to the Competition. In case of a large number of applications, the Organisers will provide for additional audition sessions.
- Second stage (16–18 October 2023) – not more than 12 participants in each instrument will be admitted. In special cases, the Jury may increase the number of qualified participants in each instrument by 1 person.
- Third stage (19–21 October 2023) – not more than 4 participants in each instrument will be admitted. In special cases, the Jury may increase the number of qualified participants in each instrument by 1 person. The performances in the third stage will be accompanied by the Symphony Orchestra of Zabrze Philharmonic under Sławomir Chrzanowski. The Organiser will provide for one rehearsal with the orchestra to the qualified participants.
- The participants should arrive at the location of auditions at least 1 hour before the auditions at each Competition stage.
- During the registration in the Organisation Office, the participant is obliged to produce an official document (identity card, passport) confirming their identity and date of birth.
- Auditions at each stage of the Competition will be carried out in alphabetical order, starting from the letter drawn by the Organiser. For organisational purposes, for important reasons and with the permission of the Chairman of the Jury, the Organisation Office shall have the right to introduce changes in the order of auditions on a particular day. The order of auditions in the form of a list will be published every time on the day preceding the audition in the following locations:

- Karol Szymanowski Academy of Music in Katowice
- accommodation of the participants
- palac.art.pl (spisakfestival.palac.art.pl) website
- The Concert of Laureates will take place on 22 October 2023. Prizes and distinctions will be officially awarded during the Concert of Laureates. All laureates shall participate in the Concert of Laureates without any additional gratification. Absence during the Concert of Laureates is equivalent to resignation from the cash prize. The programme of the Concert of Laureates shall be determined by the Jury in consultation with the laureates. The laureates shall perform the programme in line with the above-mentioned arrangements.
VIII ACCOMMODATION
- The Organiser shall guarantee stay and cover the accommodation costs for all participants for the period of participation in the Competition. The Organiser shall not guarantee stay for any persons accompanying the participants.
- The participants shall cover the individual costs of travel and meals.
- The Organiser does not provide any support in obtaining a visa. Upon a participant’s individual request, the Organiser may issue a certificate of participation in the Competition.
- The Organiser does not provide any support in obtaining a health insurance for the period of stay in Poland. It is recommended to possess the above-mentioned insurance due to unforeseeable accidents.
IX JURY
- The Jury of the Competition consists of outstanding artists – Polish and foreign musicians.
- The composition of the Jury shall be made public before the beginning of the Competition.
- The Jury Regulations shall be determined during the first session of the Jury, before the beginning of competition auditions.
- The score awarded by the Jury may be published after each stage of the Competition. The results of the Competition are the average of the second and third stages of auditions.
- The decisions of the Jury are irrevocable and unappealable.
X PRIZES
- All participants are awarded with diplomas:
- First stage – participation diploma
- Second stage – semi-finalist diploma
- Third stage – finalist diploma
- The finalists in each instrument may be awarded with the following prizes:
- First prize – gross PLN 12,000 and statuette
- Second prize – gross PLN 9,000 and statuette
- Third prize – gross PLN 6,000 and statuette
- distinction – gross PLN 3,000
- Tax shall be deducted from the prizes in accordance with the legal status effective in Poland as of 22 October 2023.
- The cash prizes shall be transferred to the bank account of the laureate within 30 days from the end date of the competition, subject to providing the Organiser with details of the bank account to which the prize is to be transferred.
- The cash prizes in the Competition shall be transferred to the benefit of the laureates on the condition that the Organiser was previously provided with all necessary data required to settle the flat-rate income tax, pursuant to Art. 30 Par. 1 Item 2 of the Personal Income Tax, in the amount of 10% of the prize value. The Competition Organiser, as a taxpayer, shall pay the flat-rate tax to the relevant tax office on behalf of the laureates.
- The prize winners are also awarded with the following title: Laureate of the 14th Michał Spisak International Music Competition.
- The Jury shall have the right to change the number and arrangement of the main prizes and distinctions, with the reservation that the overall amount of prizes and distinctions cannot be either lower or higher than stated in the Regulations.
- The Jury shall have the right not to award particular main prizes or distinctions.
- Additional prizes may be awarded regardless of the above-mentioned prizes. In the case when any additional prizes are granted, the Jury will decide about the division of such prizes.
XI COPYRIGHTS
- The participants consent to recording (especially in the form of photos and video films), use and publication of their image through any medium, including electronically on the Internet, social media and in printed form.
- The participants of the Competition shall transfer to the Organiser their proprietary copyrights related to performance of pieces during the Competition free of charge.
- The participants shall transfer the above-mentioned rights for the purpose of their use by the Organisers without a time or space limit in the below fields of exploitation:
- recording;
- multiplication by means of any technique;
- saving in computer memory, on the Internet or in a different network;
- public reproduction and performance;
- issuance;
- display;
- rental;
- lease;
- marketing;
- broadcasting, integral transmissions, retransmissions via vision or sound, wired or wireless, by satellite earth stations and systems, or via the Internet or a different network.
- The exploitation of the above-mentioned rights in the above-mentioned fields shall be made by the entities authorised by the Organiser.
- The Organisers shall not be liable for any infringement of third party copyrights by any participant of the Competition.
XII DATA PROTECTION
- Data submission is voluntary, but required in order to participate in the Competition.
- The personal data provided in the application form shall be processed in accordance with Directive 2016/79 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Council Framework Decision 95/46/EC (General Regulation on Protection of Personal Data). Legal basis Art. 6 Par. 1 lit. a of GDPR.
- The administrator of your personal data will be the Zagłębie Palace of Culture with its registered office in Dąbrowa Górnicza at Plac Wolności 1, for 2 years from the date of submission. In case when prizes are awarded, the personal data of the awarded individuals shall be processed for the accounting purposes for the period of 5 years.
- The personal data shall be processed for the purpose of organisation and promotion of the 14th Michał Spisak International Music Competition.
- On the basis of a separate consent, personal data in the form of e-mail address shall be processed in order to inform the participants about subsequent editions of the Competition, until the participant’s consent has been withdrawn. Withdrawing your approval is voluntary.
- Your personal data may be provided to the following entities:
- Personal data in the form of your name and surname will be forwarded to the entities providing accommodation services to organise accommodation for the participants.The data will also be published on the Organiser’s websites: spisakfestiwal.palac.art.pl, spisakfestival.palac.art.pl and palac.art.pl, in order to inform the participants about the order of auditions, schedule of rehearsals and results of particular stages of the Competition.
- The personal data of the participants who requested the accompanist to be provided by the Organiser, including their names and surnames, telephone numbers and e-mail addresses, will be forwarded to the accompanists for the purpose of contact, in order to determine the schedule of rehearsals, verify the programme of the Competition etc.
- Personal data in the form of your name, surname and biographical note will be forwarded to a translation agency for the purpose of translation of the text to Polish or English.
- Personal data in the form of name, surname, telephone number and e-mail address may be forwarded to sponsors or patrons that will decide to award prizes or distinctions in the Competition.
- The data including your image will be used for the marketing purposes of the Organiser, with a particular consideration of the promotional materials, through any medium, including electronically on the Internet, social media and in printed form.
- The company operating and supporting the Competition’s website, as well as the company responsible for the accounting and financial system and associated law office, may also have access to your personal data.
- When providing the personal data, the participant shall have the right to access and edit such data, restrict their processing, remove them, as well as the right to raise an objection to the supervisory body – Prezes Urzędu Ochrony Danych Osobowych (President of the Personal Data Protection Office).
- Your personal data will not be used for taking decisions by automated means, including profiling.
- It is required to accept (select) all consents for personal data processing marked with the so-called asterisk.
- Each Participant and each accompanist shall have the right to raise objections against the processing of their personal data at any time. We shall cease to process the personal data provided for the above-mentioned purposes, unless we are able to demonstrate that there are valid legally justified grounds with reference to such data, which prevail over the interests, rights and freedoms of such persons or the data will be necessary for us to potentially determine, pursue or defend against any claims.
XIII PROGRAMME OF THE COMPETITION
- The Organiser informs that it is mandatory and necessary to possess the original editions of the scores of pieces included in the programme of the Competition in each instrument. By joining the Competition, the participants certify the legality of the scores that they will use.
- The participants may introduce changes in the programme submitted for the Competition; however, not later than until 1 September 2023. Any changes shall be sent electronically to the following e-mail address: spisak@palac.art.pl.
- The duration of auditions for a single participant should not exceed: 25 minutes in the first stage, 30 minutes in the second stage and 25 minutes in the third stage (depending on the instrument).
- In the first and second stage of the competition, participants will perform solo and with piano accompaniment. In the third stage of the competition, participants will perform with orchestra.

XIV OTHER
- The Artistic Director of the Competition shall have the right to decide in any issues related to the course of the Competition which do not fall with the competence of the Jury. Such decisions shall be irrevocable and unappealable.
- The Organiser hereby reserves the right to amend these Regulations without stating a reason.
3. The Organiser shall decide in any matters not governed by these Regulations.
